This Catering Services Agreement ("Agreement") is entered into between Rejuvenation Coffee Co. LLC ("Company," "Caterer"), located at 4539 N 22ND ST #4952
PHOENIX, Arizona 85016, and the individual or entity booking services ("Client," "you"). By submitting the required deposit, the Client agrees to the terms below.
1. Services Provided
The Company will provide mobile espresso bar and coffee cart catering services ("Services") for the Client's event ("Event"), as outlined in the accepted quote or proposal. Menu offerings may include espresso drinks, lattes, cold brew, and our all-natural, seed oil-free syrups, along with dairy and non-dairy milk options. The Company may make reasonable substitutions if a specific ingredient becomes unavailable.
2. Event Details & Changes
Event details (date, time, location, and guest count) are confirmed in the proposal and in the Company’s accepted quote confirmation. Any changes to these details must be requested in writing at least 7 days before the Event and are subject to availability. Significant increases in guest count or scope may result in a revised quote and adjusted pricing.
3. Deposit & Payment
A non-refundable deposit of 50% of the total invoice is required to secure your Event date and is due upon acceptance of this agreement. The date is not held until the deposit is received.
The remaining balance is due 7 days before the Event, unless another payment schedule is agreed to in writing.
Payments not received by the due date may incur a late fee of $50 plus 4% interest per month until paid in full, and service may be postponed or withheld until the balance is settled.
We accept credit card, ACH, or check. Checks should be made payable to Rejuvenation Coffee Co LLC and mailed to the address above.
4. Venue Access & Setup
We require access to the venue at least 1 hour before the Event start time for setup, and 1 hour after the Event ends for breakdown and load-out. The Client is responsible for any venue fees, permits, or approvals needed for us to operate on-site.
5. Weather & Outdoor Service
Outdoor service is weather-dependent. Given Arizona's summer heat, we reserve the right to modify, relocate, or pause service if temperatures, wind, or monsoon conditions pose a safety risk to our staff, guests, or equipment. The temperature for outdoor service needs to remain between 40 and 90 degrees Fahrenheit. We strongly recommend shade, a tent, or an indoor backup space for any outdoor booking, particularly between May and September.
6. Power Requirements
A dedicated 120V/15-amp circuit per espresso machine is required to be provided by the Client. The Caterer will supply its own extension cords and power strips. If adequate power is not available on-site, we may be unable to safely operate our equipment, and we are not liable for any resulting service limitations.
7. Insurance
The Company maintains general liability insurance covering the Services provided at the Event. A Certificate of Insurance will be provided upon request.
8. Indemnification & Limitation of Liability
The Client agrees to indemnify and hold the Company harmless for any damage, theft, or loss of Company property caused by the negligence or misconduct of the Client, its guests, or other event staff.
Company's total liability arising out of or related to this Agreement shall not exceed the total amount paid by Client for the Services, and Company shall not be liable for any indirect, incidental, or consequential damages.
9. Cancellations & Refunds
Deposit: The deposit is non-refundable if the Client cancels the Event for any reason.
Additional payments beyond the deposit:
Cancellations made 30 or more days before the Event: any amount paid beyond the deposit will be refunded in full.
Cancellations made 8–29 days before the Event: 50% of amounts paid beyond the deposit will be refunded; the remainder may be credited toward a future booking.
Cancellations made within 7 days of the Event: no refund will be issued on amounts paid beyond the deposit.
In all cases, amounts paid may instead be credited toward a future booking, subject to availability.
Special-order items: If we've purchased custom or non-returnable items for your Event (branded cups, specialty ingredients, etc.), the Client remains responsible for those costs even if the Event is cancelled.
10. Rescheduling
Requests to reschedule made at least 72 hours before the Event will be accommodated where possible, subject to our availability on the new date. Requests made with less notice may require payment of the full Event cost. Multi-day or larger bookings require a minimum of 7 days’ notice for rescheduling. Fewer than 7 days may lead to the Client being responsible for the full event cost.
11. Force Majeure
If we're unable to fulfill our obligations due to circumstances beyond our control (severe weather, natural disaster, venue issues, or other emergencies), we may, with the Client's written approval, arrange a substitute caterer at no extra cost, or refund amounts paid. We are not liable for further damages or compensation in these situations.
12. Health & Safety
All beverages are prepared on-site by trained baristas. Please let us know in advance of any guest allergies or dietary needs. While we take care with our ingredients, we cannot guarantee an allergen-free environment.
13. Photography & Marketing
We may photograph or record video at your Event for use in our marketing and on social media. If you'd prefer we not do so, let us know in writing before the Event date.
14. Governing Law
This Agreement is governed by the laws of the State of Arizona. Any legal proceedings will be brought in the courts of Arizona.
15. Entire Agreement
This Agreement is the complete understanding between the Company and the Client regarding the Services, and supersedes any prior oral or written agreements. Changes must be made in writing. If any provision is found unenforceable, the remaining provisions stay in effect.
16. No Waiver
A delay or failure by either party to enforce any part of this Agreement does not waive that party's right to enforce it later.
17. Acceptance
By submitting the deposit, the Client acknowledges and agrees to these Terms & Conditions. Our acceptance of the deposit confirms the booking.
